ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Court. This matter involves the denial of the Petitioners’ request for an off premises beer and wine permit by the Department of Revenue based on public protests as to suitability of the location by Oralee Britton, Jean Curtis, Samuel Curtis, Laura Ellison, Charles Joe, Sharon Joe, Rumette Johnson, Vidalia McTeer, Gladys Nathaniel, Robert Pringle, Dorine Pringle, Lucille Rogers, Dorothy Toney, and Castelia Wilson. Based on the Agency Information Sheet sent by the Department, but for the public protests, the off-premises beer and wine permit would have been granted.

The hearing was scheduled for Wednesday, June, 27, 2007 and notice was sent to the parties and the protestants. At the call of the case, none of the protestants were present. The court recessed for fifteen minutes to allow additional time for the protestants to appear, but they failed to do so. Because the Department would have granted the permit but for the protests and the protest has been abandoned, it is hereby:

ORDERED that this matter is dismissed with prejudice; and

IT IS FURTHER ORDERED that the Department of Revenue issue an off-premises beer and wine permit to the Petitioner for the location at 741 N. Main Street, Sumter, South Carolina.

AND IT IS SO ORDERED.
