ORDERS:
CONSENT ORDER OF DISMISSAL
THIS
ADMINISTRATIVE APPEAL comes before the court upon the consent of the
parties for an Order to end this case because the case has been resolved by the
parties pursuant to S. C. Code Ann., § 1-23-320(f), 2005 as amended. Based on
a change of conditions at the permit site affecting the underlying facts of the
case, the parties have resolved the departmental action regarding the
Petitioner’s sign permit application on the following conditions:
1) SCDOT to issue an outdoor advertising permit to Marlin Outdoor
Advertising for a sign site at the location subject to this appeal;
2) No fees are required for the issuance of the permit;
3) The permit will be issued within ten (10) days of receipt of a new
permit application by Marlin Outdoor Advertising, Ltd.;
4) Walter Czura, on behalf of Marlin Outdoor Advertising, Ltd., will
execute a new permit application and submit it to the SCDOT’s Outdoor
Advertising Office; and
5) Marlin Outdoor Advertising, Ltd’s new permit application shall be
subject to the Highway Advertising Control Act rules and regulations in effect
on December 1, 2005.
