CONSENT ORDER OF DISMISSAL

This matter arose on the request of Petitioners Three Rivers Behavioral Health (“Three Rivers”) and Palmetto Pee Dee Behavioral Health (“Palmetto Pee Dee”) for contested case review of Respondent Department of Health and Environmental Control’s (“Department”) decision to approve Respondent Carolinas Hospital System’s (“Carolinas”) Certificate of Need (“CON”) application for the addition of twenty-four (24) psychiatric beds for the provision of geriatric crisis stabilization services. Collectively, Petitioners and Respondents are referred to as “Parties.” It now appears that the dispute among the Parties has been resolved.

The Parties agree and consent to Carolinas reducing the number of psychiatric beds for which it applied from 24 to 14. The Parties agree and consent that the Department will issue a Certificate of Need for 14 psychiatric beds for the provision of geriatriccrisis stabilization services. The parties agree and consent that the bedsfor which Carolinas seeks the CON will consist of the 12 existing beds subjectto the Department’s non-applicability determination NA-05-26, and twoadditional beds to be added to Carolinas existing bed complement.

As such, the Court orders that the Department issue to Carolinas a Certificate of Need for 14 psychiatric beds forthe provision of crisis stabilization services in accordance with the Department’s regulations.

The Court further orders that the above captioned contested case be dismissed with prejudice through this Consent Orderof Dismissal.

NOW, THEREFORE, IT IS ORDERED that thismatter be and hereby is dismissed forever with prejudice.
