ORDERS:
ORDER OF REMAND
This matter is before the Administrative Law Court (“Court”) pursuant to the appeal of James
Thompson, an inmate incarcerated with the Department of Corrections (“Department”). On June
28, 2004, Thompson filed a grievance challenging his February 4, 2004 conviction of Soliciting
Assistance From an Employee or Inmate to Violate An Agency Rule, 2.19. As a result of his
conviction, Thompson lost 80 days of good-time credit. Thompson filed his appeal with the Court
on June 28, 2004.
On August 9, 2004, the Department filed a Motion for Remand, stating that during its review
and investigation of Thompson’s claim it discovered several procedural errors in the case. As a
result, the Department believes that Thompson’s conviction should be overturned and his good time
credits restored. The Department requests that this tribunal remand the case to the Department in
order to overturn the conviction and restore the good time credits. Accordingly,
IT IS HEREBY ORDERED that this matter is remanded to the Department with
instructions that the Department overturn Thompson’s conviction of Soliciting Assistance From an
Employee or Inmate to Violate An Agency Rule (2.19) and restore the 80 days of good-time credit
that Thompson lost as a result of that conviction;
AND IT IS SO ORDERED.
