ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Judge Division ("Division") pursuant to requests for appeal of South Carolina Department of Health and Environmental Control's ("DHEC") issuance of Air Quality Construction Permit No.: 9900-0347-CA ("permit") to REA Construction Company ("REA"). Pursuant to 25 S.C. Code Ann. R. 61-62.1, et seq., Section II, Permit Requirements, Section 201, DHEC found that REA Construction Company met the requirements for issuance of said permit. Subsequently, Respondents Joe M. McCoy, Betty M. McCoy, Bonnie M. Vicari and Brenda Morgan filed notices of appeal with DHEC relative to the issuance of the permit, and DHEC timely transmitted the requests for appeal, which was filed with the Division on October 7, 1999. On or about October 8, 1999, DHEC received a request to withdraw the application for the permit from REA dated October 4, 1999. DHEC forwarded REA's request for withdrawal, which was filed with the Division on October 12, 1999. By virtue of REA's request to withdraw its application for Air Quality Construction Permit No.: 9900-0347-CA, there appears to be no further controversy for consideration by the Division.

THEREFORE, IT IS ORDERED that the above-captioned case matter is hereby DISMISSED.
