On October 17, 2002, the Court was notified by Christopher McG. Holmes, attorney for Respondent, Interstate Speedway, (Interstate) that Berkeley County has extended its sewer lines to allow Interstate to pay a tap-in fee in order to obtain service, therefore resolving the issue of the need for a septic tank permit. A copy of letter is attached hereto and made a part of this Order. There being no further controversy,



IT IS HEREBY ORDERED that the above referenced matter be and hereby is dismissed.



AND IT IS SO ORDERED.
