ORDERS:
ORDER STRIKING CASE FROM THE DOCKET
This matter is before the Administrative Law Court (ALC or Court) pursuant to the
Petitioner’s request for a contested case hearing, filed on May 3, 2004, regarding the South
Carolina Department of Health and Environmental Control’s (Department) denial of a septic tank
permit. On August 16, 2004, Melvin K. Younts, attorney for the Petitioner, filed a Motion for
Continuance with the Court in which he set forth that the parties agreed that this matter be
continued until after April 1, 2005, so that a groundwater well can be installed “to monitor water
flow and disbursement between November 2004 and April 1, 2005.” Therefore,
IT IS HEREBY ORDERED that this matter shall be stricken from the active docket.
Upon motion of any of the above parties, this matter may be reinstated without the additional
payment of any filing fees. If neither party moves for reinstatement within one year from the
date of this Order, this matter will be dismissed with prejudice at that time.
AND IT IS SO ORDERED.
