ORDER OF DISMISSAL

The above-captioned contested case was filed with the Administrative Law Court (Court) on July 8, 2004, in which the Petitioner is contesting the Department of Revenue’s (Department) denial of a retail liquor license. On August 11, 2004, Zoe Sanders Nettles, attorney for the sole Protestant, filed a letter with the Court in which she set forth that the Protestant was withdrawing his protest and there was not need for a contested case hearing in this matter. Therefore,

IT IS HEREBY ORDERED that this matter is dismissed with prejudice.

IT IS FURTHER ORDERED that the Department resume processing the Petitioner’s application for a mini-bottle license.

AND IT IS SO ORDERED.
