ORDERS:
THIRD AMENDED ORDER FOR VOLUNTARY DISMISSAL WITHOUT PREJUDICE
Petitioner, Macalloy Corporation and Respondent, South Carolina Department of Health and
Environmental Control have reached an agreement in principal on the terms and conditions of a
detailed Consent Order to settle the above-referenced action. However, additional time will be
needed for this consent order to be fully executed by designated representatives for Petitioner and
Respondent. Therefore, Petitioner Macalloy Corporation and Respondent, South Carolina
Department of Health and Environmental Control hereby move to request an additional seven (7)
days to enter into a detailed Consent Order regarding the matters before the Administrative Law
Judge Division in the above-referenced action as required by the Original Order For Voluntary
Dismissal Without Prejudice entered on February 16, 1996 (the "Dismissal Order") and the
Second Amended Order For Voluntary Dismissal Without Prejudice entered on September 9,
1996 (the "Second Amended Order"). This seven (7) day period shall begin to run on October 1,
1996. Respondent and Petitioner agree that if a detailed Consent Order is not agreed upon,
Petitioner must reinstate the above-captioned action to the docket by Monday, Octoher 7, 1996.
All other terms and conditions of the original Dismissal Order and the Second Amended Order
which have not been specifically amended or modified herein remain in effect.
