ORDERS:
ORDER AND DECISION
This matter has been pending before the Administrative Law Judge Division since February
7, 1995, pursuant to Petitioner's request for an administrative hearing regarding Respondent's denial
of a septic tank permit to Petitioner. After notice to the parties, a pre-trial conference was held at
the Administrative Law Judge Division offices, 1205 Pendleton Street, Columbia, South Carolina on
January 9, 1996. Petitioner's son, Bruce Bilsback, and Thomas G. Eppink, attorney for Respondent
appeared. As a result of the pre-trial conference the parties came to a tentative settlement agreement.
At that time, Petitioner requested opportunity to consult with an attorney and then the parties were
to inform this court if they would be able to reach an agreement to dismiss the case without prejudice.
Since that time, there have been several attempts by this office to reach the parties to determine if a
settlement had been reached. The parties have not responded.
Pursuant to ALJD Rule 23 and in the name of judicial economy,
IT IS HEREBY ORDERED that this matter be and hereby is dismissed with prejudice.
