ORDER AND DECISION

This matter comes before the Administrative Law Judge Division on the request of the Petitioner for administrative review of RD&D Permit #102332-8001 issued by the Department to Eco-Systems, Inc., on January 9, 1995. The Petitioner owns and operates a facility located in Dorchester County, South Carolina which would have been directly affected by the issuance of this permit to Eco-Systems.

Pursuant to Regulation 61-107.10, the Department has decided to revoke the permit issued to Eco-Systems upon reasons set forth in its letter dated April 27, 1995. Eco-Systems indicated that it no longer requires the permit and does not believe the administrative matter should continue. As a result of the above events, Southeastern Soil Recovery, Inc. does not object to the dismissing of the above referenced case.

For the reasons stated, it is ORDERED that this action is DISMISSED.

AND IT IS SO ORDERED.
