ORDERS:
ORDER OF DISMISSAL
By a letter dated November 7, 2001, the South Carolina Department of Health and Environmental Control (DHEC) refused
to process Petitioner's application for the use of individual sewage treatment and disposal systems in the Walnut Ridge
Subdivision because DHEC understood that a public sewer was accessible for connection to the subdivision. However,
Petitioner and DHEC have subsequently learned from the Town of Gaston that sewer service is not available for the Walnut
Ridge Subdivision. As the unavailability of sewer service to the subdivision removed DHEC's objection to Petitioner's
application for septic tank permits, DHEC has agreed to process such applications from Petitioner. In turn, by letter dated
April 22, 2002, Petitioner agreed to withdraw its request for a contested case hearing in this matter.
IT IS THEREFORE ORDERED that this case is DISMISSED, without prejudice, pending completion of the septic
system review by the Department of Health and Environmental Control.
AND IT IS SO ORDERED.
