CONSENT ORDER OF DISMISSAL
Each of the Petitioners above-named, by and with the consent of the Respondent, hereby dismiss the Petition
in the captioned case, except as necessary to preserve any rights which would otherwise be extinguished
should the Federal Court in Case No. 2-97-726-12, et al., determine that administrative review is necessary.
It is the intent of the parties that the federal court shall have exclusive and dispositive jurisdiction to consider
all issues relating to remedies at the Stoller site. It is further stipulated and agreed by and among the
Petitioners and Respondent that each or any of said Petitioners may re-file a Petition involving the same or
similar allegations and issues in the future should the federal court determination that administrative review
is necessary.
AND IT IS SO ORDERED.
