SUPPLEMENTAL ORDER

This Order shall be a Supplemental Order to the Final Order and Decision issued in this matter on May 7, 2002. It appears that there was an error in the original order as to the intervention of Bill, Mark and Rena Irwin.

Counsel for the Irwins, Grahame E. Holmes, Esquire, moved to intervene in the case. However, before the motion could be ruled on at the time of trial, Mr. Holmes withdrew his motion. The Court granted him leave to renew the motion if it became necessary during the trial of the matter. He did not renew the motion.

Therefore, the Final Order and Decision of May 7, 2002 shall be amended in following particulars:

1. The caption shall be amended to delete Bill Irwin, Mark Irwin and Rena Irwin as Intervenors.

2. Grahame E. Holmes shall be deleted from the list of attorneys in the Appearances portion of the order.

3. The final sentence under Background shall be amended to read: J. Grey Macaulay, et al. filed a timely petition for leave to intervene, alleging independent interests which could not be adequately represented by any other party; accordingly, the court granted the motion and the Macaulays were admitted as parties to this action.

All other portions of the Final Order and Decision remain as issued on May 7, 2002.

AND IT IS SO ORDERED.
