ORDERS:
ORDER OF DISMISSAL
This matter is before me pursuant to Respondent's request for a contested case hearing before the Administrative Law
Judge Division ("Division") after it received a citation issued by South Carolina Department of Labor, Licensing and
Regulation, Division of Labor ("Agency") , on August 23, 2001. On September 5, 2001, I issued an Order requiring each
party to submit to the Division a Prehearing Statement within twenty days of the date of the Order. On September 25,
2001, Agency filed its Prehearing Statement. By letter dated October 22, 2001, the Division reminded Respondent that its
Prehearing Statement was past due and instructed Respondent to file its Prehearing Statement within five days of the date
of the Order or risk default and dismissal of the case adversely to Respondent's interest. On October 25, 2001,
Respondent's President informed the Division that Respondent would not file a Prehearing Statement nor appear at any
hearing, even if its failure to do so would result in default. Accordingly,
IT IS THEREFORE ORDERED that this case is DISMISSED;
IT IS FURTHER ORDERED that the relief sought by Agency is GRANTED;
AND IT IS SO ORDERED.
