ORDERS:
SUPPLEMENTAL ORDER
Pursuant to my Order dated September 13, 1996, the South
Carolina Department of Labor, Licensing and Regulation (Real
Estate Commission) was to conduct a hearing regarding the
temporary cease and desist order issued against Respondent, James
E. MacDonald, not later than October 23, 1996 and issue an Order
not later than October 30, 1996. By letter filed by the Real
Estate Commission with the Administrative Law Judge Division on
October 14, 1996, counsel for the Commission informs me that Mr.
MacDonald has retained G. Simms McDowell, III as his counsel.
The letter also states that the Commission has filed formal
disciplinary charges against Mr. MacDonald. A hearing on the
charges was to be combined with the hearing on the cease and
desist order.
Mr. MacDonald's attorney, Mr. McDowell, has a conflict on
October 23, 1996, the date of the hearing. Furthermore, Real
Estate Commission member, Betty V. Carter of the First
Congressional District, who is required to attend the hearing
pursuant to S.C. Code Ann. 40-57-180 (Supp. 1995), will be
unable to be present at the October 23, 1996 hearing. The
hearing can be rescheduled for November, 1996. Thus, the Real
Estate Commission is requesting additional time to comply with my
Order. All parties in the above-referenced case have agreed that
additional time is necessary. Therefore, it is hereby,
ORDERED, that my Order dated September 13, 1996 is amended
to allow the Real Estate Commission time to conduct a hearing on
the cease and desist order and the formal disciplinary charges
not later than Friday, November 29, 1996 and to issue a final
decision not later than Tuesday, December 31, 1996.
AND SO IT IS ORDERED.
