ORDER OF DISMISSAL

THIS MATTER COMES before me at the request of the Respondent, Lexington County Auditor, which, with the consent of the Petitioner, Robert E. Corbett, III, moves for a voluntary dismissal of the above-captioned contested case. By letter dated March 26, 2004, and confirmed by telephone calls with the parties, the Court was notified that the Parties had settled this matter. Based on good cause shown,

IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that, pursuant to Rule 41(a)(2) of the South Carolina Rules of Civil Procedure, with the consent of all parties hereto, this action, including all claims asserted by all parties, is dismissed, with each party to bear its own attorneys’ fees and costs. That previous Order of the Court filed February 23, 2004, which set a hearing date of April 1, 2004, is vacated.

AND IT IS SO ORDERED.
