ORDERS:
ORDER OF REMAND
This matter comes before me pursuant to S.C. Code Ann. §61-2-260 (Supp. 2001) and S.C. Code Ann. § 1-23-310 et seq.
(Supp. 2001) upon Respondent South Carolina Department of Revenue's (Department) revocation of a retail liquor license
held by Petitioner TNT of Myrtle Beach, Inc, South Carolina ("Petitioner") for a location at 12 Pinewood Road, in Sumter,
South Carolina. Prior to the hearing, John B. Hilton, principal of Millwood Elementary School, and the City of Sumter
through its attorney, Martha McElveen Horne, moved to intervene. Said motion was granted. After timely notice to the
parties, a contested case hearing was scheduled for July 29, 2002, at the ALJD in Columbia, South Carolina.
After hearing the opening statements in which the various parties set forth the evidence and arguments each intended to
make, a conference was held in which all parties consented to a remand to the Department for further consideration.
Accordingly,
IT IS HEREBY ORDERED that this case is REMANDED to the Department for further consideration;
IT IS FURTHER ORDERED that any party aggrieved by a final decision of the Department may, within thirty (30) days
of the issuance of that final decision, request a contested case hearing before the Administrative Law Judge Division;
AND IT IS SO ORDERED.
