CONSENT ORDER OF DISMISSAL

This matter is before the Court based upon the Agency Transmittal of the South Carolina Department of Revenue ("Department") seeking revocation of the beer and wine permit and minibottle license held by Nancy Jenerette Hornsby for the premises doing business as Venue 44, 1928 Rosewood Drive, Columbia, South Carolina. In its transmittal, the Department alleged, inter alia, violations by the Respondent of S.C. Code Ann. §61-2-100(A); S.C. Code Ann. § 61-2-140(B), and S.C. Code Ann. § 61-4-580(5). At the same time the Department transmitted the matter to the Administrative Law Judge Division, it sought injunctive relief and filed a Motion seeking an Emergency Order temporarily suspending the permit and license held by Respondent, pending a full hearing on the merits of the permanent revocations of the Respondent's permit and license.

On May 16, 2002, the Court granted the Department's Motion for an Emergency Order; temporarily suspended the permit and license held by Respondent; and, ordered a hearing on the merits of the permanent revocations for May 28, 2002. Upon motion of Respondent, the hearing date was continued until July 2, 2002. Prior to the full hearing on the merits, the Respondent consented to the permanent revocations sought by the Department thereby making a full hearing unnecessary.

Therefore, upon the consent of the parties, it is ordered that the beer and wine permit (permit number: 32021515-PBW) and the minibottle license (license number: 32021515-PSB) in issue in this case and held by Nancy Jenerette Hornsby d/b/a Venue 44, 1928 Rosewood Drive, Columbia, South Carolina, are hereby revoked. Upon the further consent of the parties, this constitutes the full and final resolution of the above-captioned matter and the case is dismissed with prejudice.

AND IT IS SO ORDERED.
