ORDERS:
ORDER OF DISMISSAL
This matter was pending before the Administrative Law Judge Division pursuant to S.C.
Code Ann. §§ 61-4-520 and 61-6-1820 (Supp. 1996) for the issuance of an on-premises beer and
wine permit and for a sale and consumption license for Denise D. Evans, d/b/a Green's Villa Supper
Club at Route 2, Box 202, Society Hill, South Carolina. The application was protested by Patricia
McQueen.
The Order and Notice of Hearing was mailed on September 17, 1997. Petitioner, Denise D.
Evans received the notice on September 22, 1997. A hearing was conducted on Monday, November
10, 1997. The Petitioner failed to appear at the hearing.
Pursuant to Administrative Law Judge Division Rule 23, an administrative law judge may
dismiss a contested case or dispose of a contested case adverse to the defaulting party. A default
occurs when a party fails to plead or otherwise prosecute or defend, fails to appear at a hearing
without proper consent of the judge or fails to comply with any interlocutory order of the
administrative law judge. Petitioner is in default and her application for a beer and wine permit, and
sale and consumption license is considered abandoned.
Therefore, it is ORDERED, that the Petitioner's application for an on-premises beer and wine
permit and sale and consumption license at Route 2, Box 202, Society Hill is DISMISSED.
AND IT IS SO ORDERED.
