ORDERS:
FINAL DECISION (Order of Dismissal)
This matter is pending before the Administrative Law Judge Division. On September 17,
1996 an Order for Prehearing Statements was issued and mailed to all parties. The parties were
ordered to file an answer to the Order within fifteen days. On October 22, 1996, the undersigned
sent a letter to Petitioner stating that if his answer to the Order for Prehearing Statements was not
received within seven days, the case may be dismissed. As of November 19, 1996 there was still
no response from Petitioner and the undersigned's office called Petitioner and spoke with his wife
who informed this office that he was withdrawing his request for a contested case hearing. This
office informed Petitioner's wife that he needed to send a letter to the undersigned stating that he
was withdrawing and also forward a copy to the Respondent. To this date there has been no
further action in this matter. Accordingly, pursuant to ALJD Rule 23,
IT IS HEREBY ORDERED that the above-captioned matter be and hereby is dismissed
with prejudice.
