ORDERS:
CONSENT ORDER OF DISMISSAL
(Petitioner) contesting a fine levied by the
Respondent Department of Health and Environmental Control (the Department). The parties have reached agreement in this matter
and now seek this Consent Order of Dismissal as follows.
On May 5 and May 9, 2000, the Department notified the Petitioner that the Department was imposing a $10,000 fine on the Petitioner
based on alleged violations of the Petitioner's licensing requirements. The Petitioner timely appealed the Department's findings that
the Petitioner violated licensing standards and the levy of the $10,000 fine.
The parties now advise the Court that they have reached agreement on this matter. Pursuant to the agreement, the Petitioner has paid
the Department $10,000 for purposes of settling this matter and to avoid the costs of further litigation. Petitioner does not, by
payment of the fine, admit the Department's findings and conclusions with regard to the alleged violations.
IT IS ORDERED that matter be and hereby is dismissed with prejudice.
AND IT IS SO ORDERED.
