ORDERS:
CONSENT ORDER OF DISMISSAL
This matter is before the Court pursuant to a Petition for Review filed by John F. Limehouse,
seeking review of permit number OCRM-98-191-G. On July 07, 1998, OCRM issued a permit with
conditions to John F. Limehouse for the construction of a private dock on and adjacent to an
unnamed tributary off the Stono River at 496 Main Road, Johns Island, Charleston County, South
Carolina. After receiving Mr. Limehouse's notice of intent to appeal, OCRM transmitted the appeal
to Administrative Law Judge Division on August 12, 1998, and issued a Public Notice of Appeal on
August 13, 1998. No motions to intervene were filed. Prior to a hearing on the merits, the parties
notified the Court that an agreement had been reached to dismiss this action.
This Consent Order has been provided to the Court by the parties and represents their
agreement that:
1. OCRM agrees to modify permit number OCRM-98-191-G to provide for the construction
of a 4' by 362' walkway extending to an unnamed tributary of the Stono River. An 8' by 15' float will
be attached to the walkway by a '3 by 20' ramp. A drawing, dated 9/23/98, depicts the proposed
construction and is incorporated herein as Attachment A.
2. Petitioner Limehouse agrees to accept all other general conditions of the permit and to
dismiss his appeal of OCRM-98-191-G with prejudice.
THEREFORE, with the consent of the parties, it is hereby ORDERED that Docket Number
98-ALJ-07-0505-CC is hereby dismissed.
AND IT IS SO ORDERED.
