ORDERS:
CONSENT ORDER
This matter is before the court upon consent of the parties for an order finally ending the appeal. The matter was called for
trial before the undersigned on April 24, 2002 in Columbia, South Carolina. During the trial of the case the parties entered
into a settlement which was placed on the record in open court.
Based upon the representation of the parties in open court, it is hereby
ORDERED:
1. That the OCRM Division of the South Carolina Department of Health and
Environmental Control will issued to Craig and Christine Henry P/N OCRM-01-175-C allowing the construction of a 12-foot wide by 510-foot wooden bridge from the permittees' property located on Steady-Gettin-It Lane in Beaufort County,
South Carolina to a 10.5-acre island owned by Mr. and Mrs. Henry;
2. The bridge will be constructed in accordance with the plans previously submitted to OCRM as part of the permittees'
bridge permit application;
3. The bridge permit will contain the following special conditions:
(a) That the Henrys limit development of the island to one single-family residence;
(b) That only one single-family private residential dock will be constructed from the island;
(c) That a 25-foot vegetated buffer will be maintained around the island;
(d) That five acres of the island will be placed into a conservation easement which will include the 25-foot buffer and;
(e) That the Henrys will, within forty-five days of entry of this order, provide OCRM with a surveyed plat of the island
showing the location of the 25-foot buffer and conservation easement.
AND IT IS SO ORDERED.
