ORDERS:
ORDER OF REMAND
On September 12, 2001, Mary D. Shahid, attorney for Respondent Department of Health and Environmental Control,
Office of Ocean and Coastal Resource Management (OCRM), requested that this tribunal remand the above-captioned case
to OCRM so that additional conditions can be added to the permit at issue in this case. The permittee, Respondent CDI &
Seagrass, consented to the proposed changes to its permit by a signed Addendum dated August 23, 2001. By letter dated
September 20, 2001, Petitioner Richard Beck informed this tribunal that he, too, has no objection to the remand of the
permit. As all parties consent to OCRM's motion to remand and as this remand will not prejudice Petitioner's or the
public's right to bring a contested case hearing to challenge the revised permit, this tribunal grants OCRM's motion to
remand this matter.
IT IS THEREFORE ORDERED that the above-captioned case is remanded to OCRM for the addition of new conditions
to the permit at issue in this case. This case is remanded in its entirety and this tribunal relinquishes its jurisdiction over the
matter.
AND IT IS SO ORDERED.
