ORDER AND DECISION

STATEMENT OF THE CASE

This matter comes before tile Administrative Law Judge pursuant to South Carolina Code Annotated Sections 66-1-55, et seq. (Supp. 1993) and South Carolina Code Sections 1-23-310, et seq. (1986 & Supp. 1993) for a hearing pursuant to the application of Donnie L. Branham, Donnie's Bar & Grill, d/b/a Donnie's Bar & Grill. The applicant seeks an on-premises beer and wine permit and a private club's sale and consumption permit at 2660-A Ridgeway Road, Ridgeway, South Carolina. A hearing was held on November 3, 1995, at the Office of Administrative Law Judge Division, 1205 Pendleton Street, Columbia, South Carolina. Notice of the time, date and place of hearing was timely given to all parties, including the Protestants. The Protestants made no appearance at the hearing. Prior to the hearing, the Court was advised that the parties had reached a settlement agreement which would allow the issuance of the requested permits and that they wished to have the settlement reduced to a Consent Order.

Pursuant to Rule 43(K) of the South Carolina Rules of Civil Procedure, the following agreement was then read into the record:

"The requested permits and licenses will be issued upon the following conditions:

1) There shall be a separate exterior door to the private club area shown on the attached diagram of Donnie's Bar & Grill.

(2) The interior door from the private club to tile snack bar shall be permanently closed as shown on the attached diagram.

(3) The interior door between the snack bar and the private club for employees only shall be permitted as shown on the attached diagram.

(4) There shall be separate functioning restrooms for the snack bar and the private club.

(5) The construction changes referred to above shall be confirmed by SLED prior to issuance of tile permits and licenses.

6) Both the snack bar and the private club shall have separate mailing addresses which shall be confirmed by a statement from the Post Office by the applicant.

(7) Both the snack bar and the private club shall have separate sales tax numbers as shown by separate retail licenses."

ORDER Based upon the consent of the parties hereto as shown on this Order, the above

referenced agreement is made the Order of this Court.
