ORDER OF DISMISSAL

This matter comes before me pursuant to S.C. Code Ann. § 1-23-310, et seq. (Supp. 1994) for a hearing pursuant to the application of Getty E. Green, d/b/a Outback Club. The applicant seeks an on-premises beer and wine permit (AI 103315) for 211 South Main Street, Woodruff, South Carolina.

After timely notice, a hearing was held at the Administrative Law Judge Division on September 8, 1995 in Columbia, South Carolina. Chief Michael E. Cromer of the Woodruff Police Department, the protestant of record, failed to appear at the hearing, thereby, waiving his protest. Therefore, there is no opposition of record to the petitioner's application.

IT IS THEREFORE ORDERED that this matter is dismissed.

IT IS FURTHER ORDERED that the Department of Revenue and Taxation continue to process the application of Getty E. Green for an on-premises beer and wine permit at 211 South Main Street, Woodruff, South Carolina.

AND IT IS SO ORDERED.
