ORDERS:
ORDER OF DISMISSAL
This matter is currently pending before the South Carolina Administrative Law Judge
Division. This matter involves the denial of the Petitioner’s request for an off premises beer and wine
permit by the Department of Revenue based on a public protest as to suitability of the location by
James O. Altman. Based on the Agency Transmittal sent by the Department, but for the public
protest, the off premises beer and wine permit would have been granted, once the renovations to the
building have been completed and subject to the final inspection to be performed by the State Law
Enforcement Division for the Department. By letter received at the Court on August 18, 2003, the
aforementioned Protestant withdrew his protest. Because the Department would have granted the
permit but for the protest, and the protest has been withdrawn, it is hereby:
ORDERED that this matter is dismissed with prejudice; that Order dated August 14, 2003
setting a hearing date of September 2, 2003 is hereby vacated; and
IT IS FURTHER ORDERED that the Department of Revenue issue an off premises beer
and wine permit to the Petitioner upon satisfactory completion of a final inspection by the State Law
Enforcement Division for the location at 4012B Fernandina Road, Columbia, SC, South Carolina.
AND IT IS SO ORDERED.
