ORDERS:
FINAL ORDER AND DECISION
This matter was scheduled for a hearing on the merits concerning the Petitioner's request for an on-premises beer and wine
permit for 1:00 p.m., Thursday, July 20, 2000 at the Administrative Law Judge Division. Notice of the time, date, place, and
subject matter of the hearing was timely sent to all parties, including Chief Tommy Langley of the McColl Police
Department, a Protestant. At the call of the case, all parties except the Protestant were present. The Court recessed for
approximately twenty minutes and reconvened. The Protestant was not present, nor had the Protestant contacted the court.
But for the public protest about the suitability of the location, the Department of Revenue would have granted the
Petitioner's request for an on-premises beer and wine permit. Because the Protestant failed to appear for the hearing, his
protest is deemed abandoned. Therefore, it is hereby
ORDERED that the Petitioner's request for an on-premises beer and wine permit is GRANTED.
AND IT IS SO ORDERED.
