ORDER OF DISMISSAL

Introduction

This matter comes before the Administrative Law Judge Division ("Division") pursuant to the appeal of Terry Lyles, an inmate incarcerated with the Department of Corrections ("Department").

By Order of the undersigned dated November 19, 2001, it was noted that the Department in submitting the record in this case had not included a copy of the Disciplinary Hearing Report and Record or the Disciplinary Offense Report. Further, it was noted that without these documents, a proper review of Lyles' appeal could not be made.

It was therefore ordered that the Department must file with the Division the complete Record

of Lyle's appeal within 10 days of the date of the Order and that failure to do so will result in Lyle's requested relief being granted.

Although more than ten days have elapsed since the date of the Order, the Department has not filed the complete Record in this case including the Disciplinary Hearing Report and Record or the Disciplinary Offense Report.



IT IS THEREFORE ORDERED that the Final Decision of the Department is REVERSED;

IT IS FURTHER ORDERED that the Department credit Lyles with the 20 days of "good-time" credits lost as a result of his conviction;

IT IS FURTHER ORDERED that the Department credit Lyles with any good-time credit he failed to earn as a result of his conviction.

AND IT IS SO ORDERED.
