ORDER OF DISMISSAL

In the above-captioned matter, Petitioner Linda M. Stone requested a contested case hearing. Petitioner contests the decision of the South Carolina Department of Insurance denying her application for a South Carolina resident individual agent's insurance license.

On February 27, 1996, this tribunal ordered the parties to file Prehearing Statements, however, Petitioner failed to respond to this request. By letter dated March 25, 1995, Petitioner was notified by certified mail that her Prehearing Statement had not been received. Furthermore, Petitioner was given until April 4, 1996 to file her Prehearing Statement. On or about April 12, 1996, Petitioner notified this tribunal by telephone that she did not wish to pursue a contested case hearing because she was now disabled, and no longer desired to have an insurance agent's license. Petitioner was advised to confirm by letter that she wished to have her case dismissed. However, Petitioner has not provided this tribunal with written confirmation of her withdrawal of the request for a contested case. Since Petitioner has failed to comply with the interlocutory order and has indicated her desire not to proceed with this matter, her request for a contested case is deemed abandoned or withdrawn.

IT IS THEREFORE ORDERED that this matter is dismissed.

AND IT IS SO ORDERED.
