ORDER OF DISMISSAL

This matter is currently pending before the South Carolina Administrative Law Judge Division. This matter involves a request for a contested case hearing by the Respondent after a denial of the application of a beer and wine permit and sale and consumption license by the Department of Revenue. The denial was issued as a result of protests challenging the suitability of the location. A letter, signed by Douglas A. Crawford, was filed with the Division on January 8, 2003, withdrawing his protest. Since the Respondent had indicated that, but for the protest they would have granted the permit, it appears that there is no case in controversy. It is therefore,

ORDERED that this matter is dismissed, and the Respondent shall issue the permit and license as requested by the Petitioner.

AND IT IS SO ORDERED.
