ORDERS:
ORDER OF DISMISSAL
This
matter is currently pending before the South Carolina Administrative Law Court.
The Petitioner’s request for an on premises beer and wine permit and sale and
consumption (mini-bottle) license at Demetri’s, 145 Union Street, Aiken , South
Carolina, was denied by the Department of Revenue based on a public protest as
to suitability of the location by William G. and Rebecca Jackson of Aiken,
South Carolina. The Final Determination dated February 2, 2006 and sent by the
Department indicates that the protest was the only grounds for denial.
An
expedited hearing was scheduled for Friday, March 3, 2006, and notice sent to
the parties and the Protestants. At the call of the case, the Protestants were
not present. The court recessed for fifteen minutes and attempted to reach William
G. and Rebecca Jackson. The court was able to reach Rebecca Jackson who
indicated that they could not attend the hearing due to work schedules.
Because the Department would have granted the permit but for the protest and
the protest has been abandoned, it is hereby:
ORDERED that this matter is dismissed with prejudice; and
IT
IS FURTHER ORDERED that the Department of Revenue issue an on-premises beer
and wine permit and sale and consumption (mini-bottle) license to the
Petitioner for the location at 145 Union Street, Aiken , South Carolina.
AND
IT IS SO ORDERED.
