ORDER OF DISMISSAL

At the commencement of the August 2, 2005 hearing in the above-captioned matter, the parties informed this Court that they had agreed to a settlement of this case, and the terms of the settlement were read into the record in open court at that hearing. This settlement resolves all disputes between the parties in the case at hand, and pursuant to Rule 43(k), SCRCP, as applied by ALC Rule 68, the terms of the settlement are binding upon the parties. Therefore, as there are no justiciable issues remaining in controversy,

IT IS HEREBY ORDERED that, pursuant to the terms of the parties’ settlement, this matter is DISMISSED with prejudice.

IT IS FURTHER ORDERED that the caption of this case is amended, as shown above, to accurately reflect the number of Respondent’s VFW post.

AND IT IS SO ORDERED.
