ORDER OF DISMISSAL

The above-entitled case is pending before the Administrative Law Court. On December 13, 2004, Dana R. Krajack, Attorney for Petitioner, filed Notice of Motion and Motion requesting an Emergency Hearing for the suspension of Respondent’s beer and wine permit and minibottle license for the premises doing business as Club Baja, 1012 Kings Highway, Myrtle Beach, South Carolina, pending a hearing on the merits for the permanent revocation of the beer and wine permit and mini bottle license. An emergency hearing was scheduled for Friday, December 17, 2004, at 11:00 a.m., and all parties were notified.

However, on December 16, 2004, the court was notified that the parties had resolved the issue, therefore, the emergency hearing was not necessary. A consent letter was signed by both parties acknowledging the resolution of the matter to the satisfaction of the Court. There being no further controversy, IT IS HEREBY ORDERED that the above-captioned case be and hereby is dismissed and the hearing which was scheduled for Friday, December 17, 2004, at 11:00 a.m. has been canceled.

AND IT IS SO ORDERED.
