FINAL ORDER AND DECISION

I. STATEMENT OF THE CASE



The Petitioner, Brent M. Henderson, d/b/a Strokers Billiards, located at 1084 Broad Street, Building G, Sumter, South Carolina, filed an application with the South Carolina Department of Revenue (DOR), the Respondent, for a license to sell beer and wine for on-premises consumption.



The Court's file reflects that the Respondent filed a Motion to be Excused, based on information submitted in the application, and the investigation of the South Carolina Law Enforcement Division, concluding that the Petitioner met all statutory requirements for on-premises beer and wine permit. Respondent's Motion was granted by Order of this tribunal dated January 29, 2003.



The City of Sumter by correspondence dated February 4, 2003, requested leave to intervene as a party, and this request was granted by the undersigned on February 28, 2003. The City of Sumter objected to Petitioner's application.









II. STIPULATIONS

A hearing on the Petitioner's application convened before the undersigned on February 28, 2003, and, at the commencement of the hearing, the undersigned was informed that the Petitioner and the Intervenor had entered into an agreement wherein the Intervenor agreed to withdraw its protest to the Petitioner's application under the following conditions:



1) The Petitioner agrees to post "towing enforced" signs in the parking area located at 1084 Broad Street which will be available for patrons of Petitioner's business after 6:00 p.m. on week days and week-ends;

2) Petitioner agrees to use the rear door of the establishment at 1084, Building G, Broad Street, Sumter, South Carolina as an emergency exit only, unless someone is posted at the door for purposes of checking age and identification;

3) Petitioner agrees to install lights at the rear of his establishment at 1084, Building G, Broad Street, Sumter, South Carolina to aid in security with the respect to parking, and will add lights if the adjoining businesses cease to use their exterior lights at night;

4) Petitioner agrees that all servers of beer and wine working in his establishment will be at least twenty-one (21) years old;

5) Petitioner agrees to post an employee at the front door at all times for purposes of checking for age and identification;

6) Petitioner agrees to abide by all local ordinances as to licensing, hours, and noise.



The undersigned agrees that the foregoing stipulations are appropriate and should be made the Order of this Court.



III. ORDER



Subject to the above stipulations, the application of Brent M. Henderson, d/b/a Strokers Billiards for a license to sell beer and wine for on-premises consumption at 1084 Broad Street, Building G, Sumter, South Carolina is granted.



AND IT IS SO ORDERED.
