ORDER GRANTING INJUNCTION

WHEREAS, the above captioned matter, which was filed with the Court on April 23, 2008, involves a Petitioner, along with supporting exhibits, for injunctive relief pursuant to S.C. Code Ann. §§ 1-23-630, 40-1-210 and 40-1-100.

WHEREAS, in its Petitioner, the Petitioner requests that this court grant an injunction enjoining the Respondent from practicing residential building as defined in S.C. Code Ann. § 40-59-5 et. seq., while unlicensed, as well as any other appropriate relief as permitted under S.C. Code Ann. §§ 40-1-210.

WHEREAS, in its Petitioner, the Petitioner showed through accompanying documents the Respondent violated a properly served Cease and Desist Order from the Residential Builders Commission (hereinafter “Commission”) by continuing to practice in residential building after allowing his license to lapse and after receiving the Commission’s Cease and Desist Order.

WHEREAS, on June 10, 2008, this Court entered an Order of Default against Respondent pursuant to ALC Rule 23 after he failed to file an Answer to the Petition as instructed by the Court.

THEREFORE IT IS ORDERED that the Respondent is enjoined from engaging in the practice of residential building until such time, if ever, that the Respondent is properly licensed in this state.

IT IS FURTHER ORDERED that the Respondent is fined Ten Thousand ($10,000.00) Dollars.

IT IS FURTHER ORDERED that Respondent’s failure to abide by this Order will result in the initiation of contempt proceedings after which time the Respondent may be held in contempt of court and sanctioned accordingly.

AND IT IS SO ORDERED.
