ORDERS:

  CONSENT ORDER OF DISMISSAL
            This
matter is before the Court upon the Motion of the Petitioner, by and with the
consent of the Respondent. Prior to a hearing on the merits of Petitioner’s
claim, the parties reached an agreement to settle the remaining issue in this case,
which is whether Petitioner timely filed an application for disability
    retirement benefits.
  Because
Petitioner filed sufficient documentation regarding her disability claim while
she was in service, Respondent has agreed to process Petitioner’s application
for disability retirement benefits. The parties have agreed that if Petitioner
is approved for disability retirement benefits, Petitioner’s date of retirement
will be June 1, 2005, which is thirty days after Form 6151S was filed with the
    Retirement Systems. See S.C. Code Ann. § 9-1-1540 (1986 & Supp. 2007).
              NOW
THEREFORE, on motion of Robert E. Hoskins, attorney for Petitioner, and with
the consent of Kelly H. Rainsford, attorney for Respondent,
              IT
IS HEREBY ORDERED, ADJUDGED, AND DECREED that the above action is dismissed.
              IT
    IS SO ORDERED.
                                                                          _______________________________
                                                                          Honorable
    Carolyn C. Matthews
