ORDERS:
ORDER OF CONSOLIDATION
This matter is before me pursuant to Respondent, South Carolina Department of Health and
Environmental Control's ("DHEC") Motion to Consolidate the above referenced case. DHEC
moves to consolidate five appeals of South Carolina Radioactive Materials License No. 135,
issued to Interstate Nuclear Services ("INS") on December 17, 1996. The appeals were filed by
the following persons: (1) Interstate Nuclear Services Corporation; (2) Environmentalist, Inc.,
Elaine Frick, Stand Frick, Basil Garzia, D.A. Henry, Robbie Jeffcoat, Harry Rogers, Rebecca
Rogers, and Leslie Minerd; (3) Rosewood Development Association, Edisto Court Community
Council, Isaac McClinton, Lula Brown and Julius Goodwine; (4) Sierra Club; (5) and Nuclear
Maintenance Integration Corporation. The appeals all challenge various aspects of the same
license and relief sought by INS. A complete resolution of the matters appealed cannot be
afforded without considering all the claims together. Furthermore, the same witnesses will testify
concerning the issues in each appeal. Pursuant to Rule 42(a) of the South Carolina Rules of Civil
Procedure, judicial economy dictates that the matters be consolidated into one contested case.
DHEC also filed a Motion to Make More Definite and Certain and a Motion in Limine. These
motions will be addressed at a later date after the parties have had an opportunity to file
appropriate documents. Therefore, it is hereby
ORDERED, that the Motion to Consolidate is GRANTED.
AND IT IS SO ORDERED.
