ORDERS:
ORDER OF DISMISSAL
The above-entitled case is pending before the Administrative Law Judge Division (ALJD).
On November 24, 1998, a Motion to Dismiss was filed by the Respondent, South Carolina
Department of Health and Environmental Control (DHEC). DHEC asserted the Petitioner, William
W. Ritter (Ritter) failed to comply with the Procedural Order dated October 1, 1998, and also failed
to comply with the second order Denying Petitioner's Request for Postponement and Order and
Notice of Hearing dated October 21, 1998. Both orders directed Ritter to file a Pre-Hearing
Statement. No such filing was made.
A failure to comply with an order of the ALJD is a basis for dismisal of a case adverse to the
party failing to comply. ALJD Rule 23. Given the failure to comply in this case, IT IS ORDERED
that the above-captioned case be and hereby is dismissed and the hearing which was scheduled for
Monday, December 14, 1998, at 9:30 a.m. has been canceled.
AND IT IS SO ORDERED.
