This matter is before me on Motion of Kelly D. H. Lowry, Attorney for Respondent, to dismiss the above-captioned matter. Respondent states in its Motion to Dismiss, filed with the Court on March 16, 1998, that Administrative Order 97-093-W has been rescinded and requests that the above action be dismissed. Eugene C. McCall, Jr. Attorney for Petitioner, filed a letter with the Court on April 30, 1998, informing the Court that because Administrative Order

97-093-W was the basis for Petitioner's appeal, he has no objection to dismissal of the above matter.

IT IS THEREFORE ORDERED that the above-captioned case bearing Docket Number

97-ALJ-07-0737-CC is hereby dismissed.

AND IT IS SO ORDERED.
