ORDER OF DISMISSAL
This matter is before me on a Motion to Dismiss filed on September 19, 1997, by the
Department of Health and Environmental Control in the above referenced matter. On September
8, 1997, the Department received a letter from Southeastern Soil Recovery, Inc., formally
withdrawing its appeal to permits issued to Respondents Giant Resource Recovery Company, Inc.,
and Holnam, Inc. See Exhibit 1. On September 11, 1997, the Department received a letter from
TPS Technologies, Inc., also formally withdrawing its appeal. See Exhibit 2. Based upon the desire
of the Petitioners to withdraw their requests for administrative review,
IT IS HEREBY ORDERED that this matter is, DISMISSED, with prejudice.
