ORDERS:
ORDER OF DISMISSAL FOR DEFAULT
On June 9, 1997, an ORDER required all parties to file Prehearing Statements within fifteen (15)
days of the date of that ORDER. The Petitioner failed to file. On July 2, 1997, a letter was mailed
to Petitioner requiring him to file his Prehearing Statement by July 11, 1997. On July 8, 1997,
Petitioner requested an extension of time to file his Prehearing Statement. The extension was
granted until July 28, 1997. No Prehearing Statement was filed by the July 28, 1997 deadline.
Petitioner has again failed to comply with an order of the ALJD (ALJD Rule 23). Under such
circumstances, the Administrative Law Judge may dismiss a contested case for failure to comply
with an interlocutory order. ALJD Rule 23.
Therefore, IT IS ORDERED that the case be and hereby is dismissed.
