ORDER OF CONSOLIDATION
The above-captioned contested cases are pending before the Administrative Law Judge
Division, assigned to Chief Judge Marvin F. Kittrell and Judge Ralph K. Anderson, III, respectively.
Both of the contested cases involve construction permits concerning the same poultry facility and
include the same parties and the same or similar issues.
Pursuant to ALJD Rule 19D, when two or more hearings are to be held, and the same or
substantially similar evidence is relevant and material to the matters at issue at each such hearing,
the administrative law judge may, upon his own motion, order that a consolidated hearing be
conducted. Accordingly, in the interest of judicial economy, the above-captioned cases bearing
Docket Numbers 97-ALJ-07-0198-CC and 97-ALJ-07-0391-CC are hereby consolidated. They shall
bear the single docket number, 97-ALJ-07-0198-CC.
AND IT IS SO ORDERED.
