ORDERS:
CONSENT ORDER OF DISMISSAL
The above captioned matter is before the Court pursuant to the request of Petitioner
Carolina Water Service, Inc. (“CWS”) for a contested case hearing. CWS challenges the issuance
of Administrative Order 03-229-W by the South Carolina Department of Health and
Environmental Control (“Department”) relating to the River Hills wastewater collection system in
York County owned and operated by CWS. Prior to the hearing scheduled in this matter, the
parties announced that they had reached a settlement in the matter which will result in the
issuance of a consent order by the Department. The parties therefore move for and consent to a
dismissal of this case with prejudice.
This matter is therefore dismissed with prejudice in accordance with the above terms.
AND IT IS SO ORDERED.
