ORDERS:
ORDER OF SETTLEMENT AND DISMISSAL
This matter was pending before the Administrative Law Judge Division upon the request of
Petitioner, Winston A. Lawton, Jr., for administrative review of Waste Disposal System Permit
Application #1994120014 for Lots 8 and 9, Pine Island, Beaufort County, South Carolina by the
South Carolina Department of Health and Environmental Control. After an additional site inspection
and evaluation with engineers hired by Lawton and representatives of the Department, an alternate
waste disposal system will be allowed for a trial period during which the wells will be monitored for
at least eight (8) months. It appears to the Court that all parties, through agreement of telephone
conference held on Monday, August 21, 1995, consent to the dismissal without prejudice of the
above-captioned case.
THEREFORE, by and with the consent of the Petitioner and the Department, this contested
case is hereby dismissed without prejudice.
AND SO IT IS ORDERED.
