ORDER OF SETTLEMENT AND DISMISSAL

This matter came before the Administrative Law Judge Division pursuant to the petition by the City of Orangeburg, Department of Public Utilities, Water Division (City of Orangeburg) to review the decision by DHEC to issue a General NPDES permit proposing an increased in the measurement frequency from once a month to once a week. The parties engaged in discussions to try to resolve the issue.

After discussion between the parties, it appears that a settlement has been reached. Department has rescinded the general permit coverage granted by letter in July 1994. The general permit for potable water treatment facilities will be modified to change monitoring for Total Suspended Solids, Total Residual Chlorine, and Total aluminum and Phosphate Phosphorous from once a week to once a month. The parties are in accord with the settlement proposed.

It is therefore,

ORDERED, ADJUDGED AND DECREED that the Department shall issue a general NPDES permit for the Orangeburg Department of Public Utilities, with the above referenced conditions for monitoring. Upon issuance of the permit in accordance with the agreement of the parties this matter is DISMISSED WITHOUT PREJUDICE.

AND IT IS SO ORDERED.
