CONSENT ORDER OF DISMISSAL

This matter is before the South Carolina Administrative Law Court (“Court”) pursuant to the Petition of Springs Industries, Inc. (“Springs”) requesting administrative review of the final agency action by the South Carolina Department of Health and Environmental Control (“DHEC”) refusing to classify groundwater at the Wamchem Superfund Site (“Site”) Class GC waters of the State pursuant to S.C. Code Regs. 61-68. Pursuant to the Second Five Year Review Report for the Wamchem Superfund Site, located in Beaufort, Beaufort County, South Carolina, issued by the United States Environmental Protection Agency (“EPA”), Region 4, on April 29, 2004, and the findings and conclusions of which are reviewed and approved by DHEC, the parties have agreed to maintain all Site groundwater cleanup goals as set forth in the EPA Superfund Record of Decision for the Site, EPA ID. # SCD037405362, issued on June 30, 1988.

As a result of the parties in this action having reached a mutually satisfactory settlement of the issues raised in the Petition of Springs requesting administrative review of the final agency action, Petitioner and Respondent wish to dismiss this Petition.


Accordingly, by and with the consent of the parties, it is ordered and agreed that this Petition for Administrative Review is dismissed.
