ORDER OF DISMISSAL
This case was scheduled to be heard as a contested case hearing on February 12, 2002. On February 11, 2002, Petitioner
notified this office that it had received an exemption letter from the Army Corps of Engineers. Consequently, Petitioner
desires to withdraw its appeal of Respondent's denial of its Section 401 Proposed Water Quality Certification application.
Accordingly,
IT IS HEREBY ORDERED that this case is DISMISSED.
