ORDERS:
ORDER OF ABEYANCE
On August 21, 2001, a letter was received from Etta R. Williams, Attorney for Respondent, requesting an
extension of time delaying further proceedings for 30 days in order for the Petitioner to become compliant
with the Underground Storage Tank (UST) Regulations, the State Underground Petroleum Environmental
Response Bank (SUPERB) Act, and Administrative Order 00-0879-UST. Respondent further requests that a
hearing date not be set as the parties are working toward settlement negotiations, and Respondent will submit
a status report to the Court in two (2) weeks.
The interest of judicial economy requires that this case be held in abeyance.
Accordingly, no hearing will be held in this case until further order.
On September 5, 2001, Respondent shall notify the Administrative Law Judge Division of the status of this
case, and a decision will be made on whether this case shall be set for hearing or otherwise in another manner
consistent with the ends of justice.
AND IT IS SO ORDERED.
